Statement: Intimidation and death threat in Boeung Kak 1



Phnom Penh, 30 October 2013 - The Housing Rights Task Force (HRTF) and the Cambodian Human Rights Action Committee (CHRAC) condemn the brutal intimidation that were used in the past days against three families involved in a land dispute with the Khun Sear Import Export Company, in the Boeung Kak 1 area in Phnom Penh.

In the past two days, employees from the Khun Sear Company perpetrated many acts of harassment, intimidation and attempts of harms on the three families residing on a disputed plot of land in the Sangkat Boeung Kak 1. On the afternoon of the 28 October 2013 several men disturbed the peaceful business of M. Ly Srea Kheng and his wife by chasing away the potential customers. The same day, employees from the same Company threatened the families about killing their pets and, later at night, M. Ly Srea Kheng’s two dogs and Mrs. Sok Houch’s cat were poisoned and dropped in front of the houses. Moreover, chemical supposed to be insecticide were sprayed on one of the house.

During the night of 30 October 2013, at around 1:30 AM, M. Ly Srea Kheng discovered a man running from the main building. After inspection, he found that poisonous cobras were dropped near the wall of the houses. The residents caught two of the deadly snakes and killed one.

Bringing several dangerous snakes in the houses of urban poor families is more than an act of intimidation; it’s a death threat showing the intent to kill and should never been used and mostly not as tool to try to win over a land dispute.
These barbarous actions are recalling the previous and continuous coercion and violence made by worker hired by Khun Sear Import Export Company. Since May 2013, the residents had their property destroyed, their business demolished, their physical security threatened and violated, their water pipes and electricity cut off as well as five of their pets killed. No real actions were ever taken by the local authorities against the perpetrators.

The HRTF and CHRAC are strongly condemning these continuous attempts of intimidation, violence and death threats against three families, residing legally for decades on their plot of land in Boeung Kak 1. The HRTF and CHRAC call on the judicial authorities to take appropriate and quick sanctions against the perpetrators in order to ensure the fulfillment of the Government’s duty to protect the security of its citizens.

ថ្ងៃនេះ អង្គការ​មិនមែន​រដ្ឋាភិបាល​សំខាន់ៗ និង តំណាង​សហគមន៍ បាន​អំពាវ​នាវ​​ឲ្យមាន​កំណែ​ទម្រង់​ដីធ្លី​និង​លំនៅដ្ឋាន​ប្រកបដោយ​និរន្តរភាព​និង​ដោយ​មាន​ការចូលរួម​ពេញលេញ នៅ​ក្នុង​សន្និសីទ​កាសែត​មួយ ដែល​នៅក្នុង​នោះ​ បញ្ហា​នានា​ ដូចជា​ការបណ្តេញ​ចេញ​ដោយ​បង្ខំ ផលប៉ះពាល់​នៃ​ភាព​គ្មាន​ដីធ្លី និង ស្ថានភាព​នៃ​សកម្មជន​ដីធ្លី​និង​លំនៅដ្ឋាន នៅកម្ពុជា ត្រូវ​បាន​ពិភាក្សា។

​គណៈកម្មាធិការប្រព្រឹត្តិកម្ម នៃ អង្គការសមាគមការពារសិទ្ធិមនុស្សកម្ពុជា (CHRAC) សមាគមការពារសិទ្ធិ មនុស្ស និង ​អភិវឌ្ឍន៍​​នៅកម្ពុជា (ADHOC) វេទិកា​នៃអង្គការ​មិនមែន​រដ្ឋាភិបាល​ស្តីពី​កម្ពុជា (NGO Forum) និង ក្រុមការងារ​ពិសេស​សិទ្ធិលំនៅដ្ឋាន (HRTF) បាន​អំពាវ​សុំ​ឲ្យ​​រាជរដ្ឋាភិបាល​កម្ពុជា​ចាត់​វិធាន​ការ​ដើម្បី​គាំទ្រ​​ប្រជាពលរដ្ឋ​ក្រីក្រ​និង​ជនងាយរងគ្រោះ​​កម្ពុជា ទាក់ទិននឹង​ការ​កែលម្អ​វិស័យដីធ្លី​និង​លំនៅដ្ឋាន។
រាជរដ្ឋាភិបាលកម្ពុជា ទទួលស្គាល់​ថា​កំណែទម្រង់ដីធ្លី​មាន​សារៈ​​សំខាន់​ក្រៃលែង​​ដើម្បី​លើកកម្ពស់​ស្ថេរភាព​សង្គម និង ដើម្បី​សម្រេច​បាន​គោលដៅ​រួម​នៃ​ការ​កាត់បន្ថយ​ភាពក្រីក្រ។ ប៉ុន្តែ នៅមាន​បញ្ហា​ជាច្រើន​ដែល​ត្រូវ​ដោះស្រាយ។

ចំនួន​ប្រជាពលរដ្ឋ​ក្រីក្រ​និង​ជនងាយរងគ្រោះ​កាន់តែច្រើនឡើង ​បាននឹងកំពុងទទួលរងការ​បណ្តេញ​ចេញ​ពី​ដី​របស់​ពួកគេ។ ការបណ្តេញ​ចេញ​ដោយ​បង្ខំ​បាន​​​ធ្វើ​ឲ្យ​​ជីវភាពប្រជាពលរដ្ឋ​ធ្លាក់​ចុះ និង ប៉ះពាល់ដល់សិទ្ធិ​ជាមូលដ្ឋានរបស់ពួកគាត់។  

តាំងពីឆ្នាំ ២០០០ មក យ៉ាងហោចណាស់​ប្រជាជន​ចំនួន ៧០០.០០០ ក្នុង​ទូទាំងប្រទេស​បាន​ទទួល​រង​ផលប៉ះពាល់​ពី​ការចាប់​យកដី និង ការ​រើ​លំនៅដ្ឋាន​ដោយ​បង្ខំ រួមមាន​ប្រជាជន​ចំនួន ៥១.០០០ នាក់​ក្នុង​ឆ្នាំ ២០១១។  នៅ​រាជធានី​ភ្នំពេញ យ៉ាងហោចណាស់​ប្រជាជន​ចំនួន ១៤៥.០០០ នាក់ ឬ ប្រហែល ១០% នៃ​ចំនួន​ប្រជាជន​នៃ​រាជធានី ត្រូវ​បាន​បណ្តេញ​ចេញ​ តាំងពី​​ឆ្នាំ ២០០០។ នៅ​ចុងឆ្នាំ ២០១១ ប្រជាជន​ជិត ៤០.០០០ នាក់ ស្ថិត​ក្រោម​ការ​គម្រាមកំហែងភ្លាមៗ​នៃ​ការបណ្តេញ​ចេញ។

លោក សៀ ភារម្យ ប្រធាន​លេខា​ធិការដ្ឋាន​នៃ​ក្រុមការងារ​ពិសេស​សិទ្ធិលំនៅដ្ឋាន (HRTF) បាន​មាន​ប្រសាសន៍ថា “សហគមន៍​កាន់​តែ​ជួប្រទះ​ហានិភ័យ​នៃ​ការបណ្តេញ​ចេញ​ដោយ​បង្ខំ និង សំណង​មិន​គ្រប់​គ្រាន់” ។

លោក​បានមានប្រសាសន៍​​បន្ថែមថា “បន្ថែម​លើ​ការបណ្តេញ​ចេញ​នៅ​តំបន់​បឹងកក់ ការរំលោភ​ធ្ងន់ធ្ងរ​លើ​​សិទ្ធិលំនៅដ្ឋាន​បាន​កើតឡើង​នៅ​ដើម​​ឆ្នាំ ២០១២ នៅ​​សហគមន៍​បុរីកីឡា” ។

តំណាង​សហគមន៍ ក៏​​និយាយ​ផងដែរ ​ដោយ​លើកឡើង​ពី​បទពិសោធន៍​របស់​ពួកគេ​ចំពោះ​ការរំលោភ​សិទ្ធិ​មនុស្សដែល​បាន​កើតឡើង​នៅ​តំបន់​បឹងកក់ និង ខេត្ត​ពោធិសាត់។

លោក ឈិត សំអាត នាយក​ប្រតិបត្តិ​នៃ​វេទិកា​នៃអង្គការ​មិនមែន​រដ្ឋាភិបាល​ស្តីពី​កម្ពុជា បាន​និយាយ​ថា មាន​ភាពចាំបាច់​ត្រូវ​កែលំអ​ស្ថានភាព​នៃ​ប្រជាជន​ងាយរងគ្រោះបំផុត​នៅ​កម្ពុជា​ទាក់ទិននឹង​ការកាន់កាប់ដី។
“វាគឺជា​ប្រការ​សំខាន់​បំផុត​ដែល​យើង​ត្រូវ​មើលឃើញ​វឌ្ឍនភាព​នៅក្នុង​វិស័យ​ទាំងនេះ​នៅកម្ពុជា។ បច្ចុប្បន្ន ភាពគ្មានដីធ្លី​ត្រូវ​បាន​ប៉ាន់ស្មាន​ថា​មាន​ពី ២០-២៥% ក្នុង​ចំណោម​ចំនួន​ប្រជាជន​សរុប។”

ទោះបី​ជា​ការ​ចាប់​យកដី​គឺជា​បញ្ហា​សំខាន់​ខ្លាំង​ក្តី ក៏​គេ​ឃើញ​មាន​ការបារម្ភ​ផងដែរ​អំពី​ផលប៉ះពាល់​នៃ​ការវិនិយោគ​​បរទេស​ធំៗ​នៅក្នុងវិស័យ​កសិកម្ម និង កសិ-ធុរកិច្ច តាមរយៈ​ការ​ផ្តល់​សម្បទាន​ដី​សេដ្ឋកិច្ច (ELCs)។

លោក សុខ សំអឿន ប្រធាន​​គណៈកម្មាធិការប្រព្រឹត្តិកម្ម នៃ អង្គការសមាគមការពារសិទ្ធិមនុស្សកម្ពុជា (CHRAC) បាន​លើកឡើងថា “យើង​ត្រូវ​ការ​តម្លាភាព​បន្ថែមទៀត​លើ​បញ្ហា​នេះ ដែល​នៅក្នុង​នោះសម្បទាន​​​ដី​​សេដ្ឋកិច្ច​នៅ​តែ​បន្ត​មាន ទោះបី​ជារាជរដ្ឋាភិបាល​បាន​ប្រកាស​ឱសានវាទ​លើ​សម្បទាន​ដី​សេដ្ឋកិច្ច​ក្តី” ។

វាគឺជា​ប្រការ​សំខាន់​បំផុត​ដែល​រាជរដ្ឋាភិបាលកម្ពុជា​ធានា​ឲ្យ​បាន​ថា​​ ការ​ពិនិត្យមើលឡើងវិញ​លើសម្បទាន​​ដី​សេដ្ឋកិច្ច ត្រូវ​បាន​អនុវត្ត​ប្រកបដោយ​តម្លាភាព​និង​ដោយ​មាន​ការចូលរួម និង ​ព័ត៌មាន​ត្រូវ​បាន​ផ្សព្វផ្សាយ​ជាសាធារណៈ។

អង្គការ​មិនមែន​រដ្ឋាភិបាល បាន​សម្តែង​កង្វល់​ដ៏​ធំ​អំពី​ស្ថាន​ភាព​របស់​សកម្មជន​សិទ្ធិ​ដីធ្លី​និងសិទ្ធិលំនៅដ្ឋាន។ ក្នុង​ឆ្នាំ ២០១២ កំណើន​ការ​ចាប់​ខ្លួន​និង​ការ​រំលោភ​សិទ្ធិ​មនុស្ស​បាន​កើតឡើង​ នៅពេល​ដែល​​សហគមន៍​ព្យាយាម​សង្គ្រោះ​លំនៅដ្ឋាន​របស់​ខ្លួន។

លោក ធន សារ៉ាយ ប្រធាន​ សមាគមការពារសិទ្ធិមនុស្ស និង ​អភិវឌ្ឍន៍​​នៅកម្ពុជា (ADHOC) បាន​បន្ថែមថា “យើង​ខ្ញុំ​សូម​អំពាវនាវ​ដល់​រាជរដ្ឋាភិបាល​​​ដោះលែង​លោក​ស្រី យ៉ោម​ បុប្ឆា សកម្មជន​សិទ្ធិ​ដីធ្លី​និង​​លំនៅដ្ឋាន និង ជាអតីត​អ្នក​រស់នៅ​​បឹងកក់ ដែល​នៅពេល​ថ្មី​ៗ​នេះ​ត្រូវ​បាន​ផ្តន្ទាទោស​ដាក់​ពន្ធនាគារ​រយៈពេល​បី​ឆ្នាំ ចំពោះ​ការពាក់ព័ន្ធ​របស់​លោកស្រី​នៅក្នុង​ការព្យាយាម​ការពារ​លំនៅដ្ឋាន​របស់​សហគមន៍ និង ទាមទារ​សំណង​​គ្រប់គ្រាន់​ ក្រោយពេល​ដែល​រាជរដ្ឋាភិបាល​បាន​ជួល​ដី​ពួកគេ​សម្រាប់​ការអភិវឌ្ឍ។”

វាគ្មិន​ទាំងឡាយ​ បាន​ទទួលស្គាល់​ថា​គំនិតផ្តួចផ្តើម​របស់​រាជរដ្ឋាភិបាល​ក្នុង​​កំណែទម្រង់ដីធ្លី និង បទបញ្ជា​លេខ ០១ គឺមានលក្ខណៈទាន់​ពេល​និង​គួរ​ឲ្យ​សរសើរ ប៉ុន្តែមាន​បញ្ហា​ប្រឈម​ក្នុង​ការអនុវត្ត។ ការ​កាប់​ឆ្ការ​ដី​ដាំដំណាំ​និង​ការ​ទន្ទ្រាន​យកដី​ដោយ​ក្រុមហ៊ុន​ នៅ​តែ​កើតឡើង។ ដោយឡែក ជនជាតិដើម​ភាគតិច​ជួប​ប្រទះ​ការលំបាក។ មានភាពចាំបាច់​ត្រូវ​ផ្តល់​អាទិភាព​ចំពោះ​ការចុះបញ្ជីដី​ធ្លីមានលក្ខណៈជាប្រព័ន្ធ​ជូន​​សហគមន៍​ក្រីក្រ​នៅតាម​ខេត្ត​និង​ក្រុង​ដែល​មាន​វិវាទ ដោយជៀសវាង​មិនរាប់បញ្ចូលក្នុង​​កិច្ចដំណើរការ​នេះ។
តំណាង​អង្គការ​មិនមែន​រដ្ឋាភិបាល បាន​និយាយថា​ស្ថានភាព​ទាក់ទិននឹង​ការ​ចាប់​យកដី ភាពគ្មានដីធ្លី និង ការ​ចោទប្រកាន់​​សកម្មជនដីធ្លី មាន​លក្ខណៈ​កាន់​តែ​ដុនដាប​​ក្នុង​ឆ្នាំ ២០១២។ ពួកគេ​បាន​អំពាវនាវ​សូមឲ្យ​​រាជរដ្ឋាភិបាល​​អនុវត្ត​កំណែទម្រង់​ ដើម្បី​ដោះស្រាយ​បញ្ហា​ទាំងនេះ​​ក្នុង​ឆ្នាំ ២០១៣។ អាស្រ័យ​ហេតុនេះ ពួកគេ​បាន​ដាក់​ជូន​​អនុសាសន៍​ខាងក្រោម​នេះ​ជូន​​រាជរដ្ឋាភិបាលកម្ពុជាៈ

អនុសាសន៍៖
·         បញ្ឈប់​ការបណ្តេញ​ចេញ​ដោយ​បង្ខំ និង ធានា​ឲ្យ​បាន​ថា​​សហគមន៍​ទទួល​បាន​ការប្រព្រឹត្តិ​ប្រកប​ដោយ​យុត្តិធម៌​ទាក់ទិននឹង​សំណង​ និង​ ទីកន្លែង​នៃ​ការតាំង​លំនៅដ្ឋាន​ថ្មី​នៅ​ពេល​មាន​ការ​​រើ​លំនៅ​ដ្ឋាន។
·         ផ្តល់​អាទិភាព​ដល់​​ការចុះបញ្ជីដី​ជាប្រព័ន្ធ​ជូន​សហគមន៍​ក្រីក្រ​នៅតាម​ខេត្ត​និង​នៅទីក្រុង និង ពន្លឿន​ការផ្តល់​កម្មសិទ្ធិដីធ្លី។
·         ធានា​ឲ្យ​បាននូវនីតិវិធី ការសន្ទនា​សមស្រប ព័ត៌មាន​សមស្រប និង ការចរចារ​ប្រកបដោយ​យុត្តិធម៌​ទាក់ទិននឹង​ការ​តាំងលំនៅដ្ឋាន​ថ្មី​នៃ​សហគមន៍។
·         ធានា​ឲ្យ​បាន​ថា​ឱសានវាទ​លើ​​សម្បទាន​​ដី​សេដ្ឋកិច្ច​ត្រូវ​បាន​គោរព​អនុវត្ត​យ៉ាង​ពេញលេញ និង ថា​ពុំ​មាន​​ផ្តល់​សម្បទាន​​ដី​សេដ្ឋកិច្ច​អនាគត​ទៀតទេ។ ធានា​ឲ្យ​បាន​ថា​នីតិវិធី​នៃ​ការពិនិត្យមើល​ឡើង​វិញ​នូវ​សម្បទាន​ដី​សេដ្ឋកិច្ច គឺ​មាន​តម្លាភាព និង ត្រូវ​បាន​អនុវត្ត​ជា​អាទិភាព​មួយ។
·         ធានា​ឲ្យ​បាន​ថា​វិវាទ​បច្ចុប្បន្ន​រវាង​សម្បទានិក​​ដី​សេដ្ឋកិច្ច និង ​សហគមន៍​មូលដ្ឋាន​ត្រូវ​បាន​ដោះ​ស្រាយ​​​​​តាម​ពេល​វេលា​សមស្រប។
·         ការកំណត់​​ព្រំប្រទល់ៈ ធានា​ឲ្យ​បាន​ថា​ការការកំណត់ព្រំប្រទល់​ដី​របស់​រដ្ឋ​ និង ដី​ឯកជន ក៏ដូចជា តំបន់​ការពារ និង តំបន់​ព្រៃ​សហគមន៍ ត្រូវ​បាន​អនុវត្ត​ជាអាទិភាព​មួយ និង ដំណើរការប្រកប​តម្លា​ភាព។ សូម​ផ្សព្វផ្សាយ​ជាសាធារណៈ​នូវ​ផែនទី​ដី​របស់​រដ្ឋ។
·         ធានា​ឲ្យ​បាន​ថា​សារាចរ​លេខ ០៣ ដែល​គាំទ្រ​គំនិតផ្តួចផ្តើម​ថ្នាក់​ក្រោម​ជាតិ ត្រូវ​បាន​គាំទ្រ​តាមរយៈ​​ការបើក​ទូលាយ​ដោយ​អាជ្ញាធរ​នៅក្នុង​ការ​កំណត់​ដំណោះស្រាយ​លំនៅដ្ឋាន​សមរម្យ និង បំភ្លឺ​នីតិវិធី​ជុំវិញ​ការអនុវត្ត​សារាចរ​នេះ។
·         ធានា​ឲ្យ​បាន​ថា​បទបញ្ជា​លេខ ០១ ត្រូវ​បាន​អនុវត្ត ដើម្បី​គាំទ្រ​​ប្រជាពលរដ្ឋ​ក្រីក្រ​និង​ងាយរងគ្រោះ​កម្ពុជា និង ថាបញ្ជា​នេះ​មិនធ្វើ​ឲ្យ​ខូចខាត​ដល់​​ការចុះ​បញ្ជី​ដី​សហគមន៍​ជន​ជាតិ​ដើម​ភាគតិចឡើយ។
·         សូម​ដោះលែង​សកម្មជន លោកស្រី យ៉ោម​ បុប្ផា និង បញ្ឈប់​ការរារាំង​ដល់​សកម្មភាព​គ្មាន​ហិង្សា​ដោយ​​សហគមន៍ ដូចជា​ធ្វើញ្ញ​ត្តិ​ និង សំណើ​ជាដើម។
·         ធានា​ឲ្យ​បាន​ថា​ព័ត៌មាន​អំពី​ការវិនិយោគ​នាពេលអនាគត​ត្រូវ​បាន​ផ្សព្វផ្សាយ​ជាមុន និង ​ការសិក្សា​វាយតម្លៃ​ហេតុប៉ះពាល់​បរិស្ថាន​និង​សង្គម​ពេញលេញ​ត្រូវ​បាន​អនុវត្ត។
·         ពិគ្រោះ​ជាមួយ​​សហគមន៍​រងផលប៉ះពាល់​មុនពេល​អនុវត្ត​គម្រោង​អភិវឌ្ឍ​ ទន្ទឹម​គ្នា​នឹង​ការ​អនុវត្ត​ទស្សនាទាន​នៃ​ការយល់ព្រម​ដោយ​សេរី ជាមុន និង ដោយ​មាន​ព័ត៌មាន​គ្រប់គ្រាន់។
·         ផ្សព្វផ្សាយ​ជាសាធារណៈ​នូវព័ត៌មាន​ស្តីពី​កិច្ចសន្យា​និង​កិច្ចព្រមព្រៀង ប្រាក់ចំណូល និង ចំណាយ។
·         ពន្លឿន​កិច្ចដំណើរការ​ទទួលស្គាល់សហគមន៍​ព្រៃឈើ​​ និង តំបន់ការពារ។

Situation of Land/Housing Rights and Activists in 2012 and the Way Forward
Major NGOs and community representatives today called for sustainable and inclusive land and housing reforms, in a media conference at which issues such as forced evictions, the impact of landlessness and the position of land and housing activists in Cambodia were discussed.

The heads of The Cambodian Human Rights Action Committee (CHRAC), the Cambodian Human Rights Development Association (ADHOC), the NGO Forum on Cambodia and the Housing Rights Task Force (HRTF) called on the Royal Government of Cambodia to take measures to support Cambodia’s poor and vulnerable people in regard to land and housing improvements.

The RGC recognizes that land reform is vital to enhance social stability and to meet the overall goal of poverty reduction. Yet many issues need to be addressed. Escalating numbers of poor and vulnerable people are being driven from their land.  Forced evictions have degraded the livelihoods of communities and affected on their basic human rights. 

Since 2000 at least 700,000 people across the country have been affected by land grabbing and forced displacement, including 51,000 people in 2011.  In Phnom Penh at least 145,000, or approximately 10% of the city’s population, have been evicted since 2000. At the end of 2011 almost 40,000 residents were under immediate threat of eviction.

Communities are increasingly at risk of forced evictions and inadequate compensation, said Mr Sia Phearum, HRTF Secretariat Chief.

“In addition to the Boeng Kak Lake evictions, serious housing rights violations occurred in early 2012 at Borey Keila community”, he said.

Community speakers also spoke outlining their own experiences of violations of human rights which have occurred at Boeng Kak Lake and Pursat Province.
Mr Chhith Sam Ath, Executive Director of the NGO Forum on Cambodia, said that there was an urgent need to improve the position of Cambodia’s most vulnerable in regard to land possession.

“It is vital that we see progress in these areas in Cambodia. Currently landlessness is estimated at between 20-25% of the total population.”
While land grabbing is the critical issue, there are also concerns over the effects of large scale foreign investments in agriculture and agri-business through the granting of Economic Land Concessions (ELCs).

“We need greater transparency on the issues of which ELCs are still proceeding, despite the Government’s stated moratorium on these”,  said Mr Sok Sam Oeun, CHRAC Chairman.

It is vital that RGC ensures that the announced review of ELCs is carried out in a transparent and participatory way and that information is made publicly available.
NGOs expressed great concern over the position of land and housing rights activists.  During 2012 increasing arrests and human rights violations occurred as communities sought to save their homes.

“We call on the Government to release Ms Yorm Bopha, land and housing rights activist and former Boeng Kak Lake resident, recently jailed for three years for her involvement in trying to protect the community’s homes and gain adequate compensation after the government leased their land for development, “ said ADHOC President Mr Thun Saray.

Speakers acknowledged that the Government’s initiatives in land reform and Executive Order 01 are timely and laudable, but there are challenges in implementation.  Clearance of crops and land encroachment by companies still occur. Indigenous people are particularly disadvantaged. There is a need for prioritizing systematic land registration for poor communities in provinces and cities where disputes occur, avoiding further exclusions of areas from this process
NGO representatives said that the position in regard to land grabbing, landlessness and prosecution of activists had worsened in 2012. They called on the Government to enact reforms to address these issues in 2013. They therefore put forward the following recommendations to be accepted by the RGC as follows:

RECOMMENDATIONS:
·         End forced evictions, and ensure communities are fairly treated in regard to compensation and relocation sites when movement occurs
·         Prioritize  systematic land registration for poor communities in provinces and cities and expedite granting land ownership
·         Ensure due process, proper dialogue, appropriate information and fair negotiation regarding relocation of communities
·         Ensure the process of review of Economic Land Concessions is transparent
·         Ensure that existing disputes between ELC concessionaires and local communities are resolved in due time
·         Boundary demarcation – ensure that the demarcation of state land and private land, as well as protected areas and community forestry areas are carried out as a priority and that the process is transparent. Make a State Land Map database publicly accessible.
·         Ensure that Circular 03, supporting sub-national level initiatives, is supported through openness of authorities in identifying decent housing solutions, and clarify the process surrounding its implementation
·         Ensure that Executive Order O1 is implemented to support the poor and vulnerable of Cambodia and that it is not undermining Indigenous Peoples communal land registration
·         Free land activist Ms Yorm Bopha, and end obstruction of non-violent activities by communities, such as petitions and requests
·         Ensure that information about upcoming investments is disseminated in advance and full environmental and social impact studies are undertaken
·         Consult with affected communities before proceedings with developments, while following the concept of Free, Prior, Informed Consent
·         Make publicly available information on contracts and agreements, revenues and spending
·         Do not grant concessions for community lands which have been already registered
·         Speed up the process of community forestry and protected area recognition
·         Adopt and implement National Housing Policy, which has been drafted since 2006.

Statement: Regrets the Unfair Judgment on Boeung Kak Lake Residents


STATEMENT
“CHRAC Regrets the Unfair Judgment on Boeung Kak Lake Residents”
Phnom Penh, 27 December 2012

The Cambodian Human Rights Action Committee (CHRAC)—a coalition of 21 NGO members—is so disappointed at the decision today by the Phnom Penh Municipal Court to sentence Ms. Yorm Bopha, a land and housing rights activist and former Boeung Kak Lake resident, to three years in prison.  Her husband, Lous Sakorm, was convicted of the same crime and handed a three year suspended sentence, while her two brothers, Yorm Kamhong and Yorm Seth, were tried in abstentia, and handed three year sentences pending their arrest after a warrant was issued today. The four have each been ordered to pay 30 million Riels in compensation, a total of $15,000 for both victims.  The trial was marked by irregularities, while the integrity of the decision is seriously undermined by the lack of evidence presented at the court.  Instead, the conviction of Yorm Bopha highlights the judicial harassment faced by activists willing to oppose the authorities and powerful private companies in the pursuit of their land rights.

Background
On 04 September 2012, Yorm Bopha, a popular Boeung Kak community representative, was accused of assaulting a suspected thief – allegations she has denied. She was detained at Prey Sar prison for more than 100 days until her trial on 26-27 December 2012, at which she was handed a 3 year sentence and a large fine, under Article 218 of the Penal Code (“intentional violence with aggravating circumstances”).

Yorm Bopha played a central role in the Boeung Kak Lake residents’ campaign to protect their homes and gain adequate compensation after the government leased their land to development firm Shukaku Inc. She was also at the forefront of the campaign for the release of 15 female former lake residents who were detained arbitrarily in May 2012 following a peaceful protest. Yorm Bopha has refused to be silenced, despite reporting on a number of occasions that she has faced intimidation and harassment by authorities, and the long sentence handed to her and the hefty fine cannot be divorced from her activism.


The Trial
The judicial process against Yorm Bopha has been flawed from the beginning, when she was arrested one month after the crime was alleged to have been committed, and then questioned without a lawyer present. During the trial, the judge failed to take into account the argument presented by the defense, instead relying on evidence that was flimsy to say the least.

Three of the witnesses called to testify against Yorm Bopha told contradictory accounts of the events. It was later apparent that two of the witnesses could not be sure who Yorm Bopha or her husband was, only that they had seen both men and women at the incident. It also emerged that one witness had gone for dinner that evening, but could not recall who with due to his state of inebriation, but could however recall that Yorm Bopha was present at the incident. With such grounds for reasonable doubt, the conviction of Yorm Bopha and prison sentence she has received calls into question the competence of the Cambodian judiciary.

Conclusion
CHRAC calls on the higher courts to overturn the judgment of the Phnom Penh Municipal Court in order to release her freely, in case her appeals are to be lodged. In a striking juxtaposition between the judicial treatment of rich and poor, Chhouk Bandith, the former Bavet City governor, saw charges dropped against him by Svay Rieng provincial court citing insufficient evidence this week in a case whereby he was accused of shooting 3 protesters at a strike outside a garment factory in February. This was despite numerous witness accounts and his alleged confession of the incident. The detention of Yorm Bopha, convicted on exceptionally weak evidence in a case that must be seen in light of her activist work, serves to demonstrate that justice in Cambodia is the preserve of the rich and powerful, while poorer Cambodian who stand up for their rights can expect harassment and imprisonment as a matter of course.

THE ADOPTION OF THE ASEAN HUMAN RIGHTS DECLARATION

We don't know the real content of ASEAN Human Rights Declaration. However the declaration has been demanded from civil society within ASEAN countries because they thought that it doesn't meet with international standard. The Cambodian government as head of ASEAN rejected all request from civil society because she thinks that it's not good to consult with civil society.

PHNOM PENH STATEMENT
ON THE ADOPTION OF THE ASEAN HUMAN RIGHTS DECLARATION (AHRD)

WE, the Heads of State/Government of the Member States of the Association of Southeast Asian Nations (ASEAN), on the occasion of the 21st ASEAN Summit in Phnom Penh, Cambodia;

REAFFIRMING ASEAN’s commitment to the promotion and protection of human rights and fundamental freedoms as well as the purposes and the principles as enshrined in the ASEAN Charter, including the principles of democracy, rule of law and good governance;

REITERATING ASEAN and its Member States’ commitment to the Charter of the United Nations, the Universal Declaration of Human Rights, the Vienna Declaration and Programme of Action, and other international human rights instruments, to which ASEAN Member States are parties as well as to relevant ASEAN declarations and instruments pertaining to human rights; 

ACKNOWLEDGING the importance of the role of the ASEAN Intergovernmental Commission on Human Rights (AICHR), as the overarching institution responsible for the promotion and protection of human rights in ASEAN, that contributes towards the building of a people-oriented ASEAN Community and as a vehicle for progressive social development and justice, the full realization of human dignity and the attainment of a higher quality of life for ASEAN peoples;

COMMENDING AICHR for developing a comprehensive declaration on human rights, in consultation with ASEAN Sectoral Bodies and other relevant stakeholders;

ACKNOWLEDGING the meaningful contribution of ASEAN Sectoral Bodies and other relevant stakeholders in the promotion and protection of human rights in ASEAN, and encourage their continuing engagement and dialogue with the AICHR;

DO HEREBY:
1. ADOPT the ASEAN Human Rights Declaration (AHRD);

2. AFFIRM our commitment to the full implementation of the AHRD to advance the promotion and protection of human rights in the region; and

3. REAFFIRM further our commitment to ensure that the implementation of the AHRD be in accordance with our commitment to the Charter of the United Nations, the Universal Declaration of Human Rights, the Vienna Declaration and Program of Action, and other international human rights instruments to which ASEAN Member States are parties, as well as to relevant ASEAN declarations and instruments pertaining to human rights.

ASEAN People Forum issued Joint statement today

Phnom Penh, Cambodia

Preamble
We, more than 1,200 delegates representing various civil society organizations and movements of workers from rural and urban sectors as well as the migrant sector, peasants and farmers, women, children, youth, the elderly, persons with disabilities, urban poor, Indigenous Peoples, victims of human rights violations, domestic workers, lesbian gay transgender/transsexual intersex and queer (LGBTIQ) people, human rights defenders and other groups, gathered together in Phnom Penh for the 2012 ASEAN Civil Society Conference / Peoples’ Forum (ACSC/APF) on 29-31 March 2012, to discuss issues under the theme “Transforming ASEAN into a People Centered Community”.

We reaffirm our commitment to ensure that ASEAN upholds the fundamental principles of democracy, rule of law, human rights and dignity, good governance, the best interests of the child, meaningful, substantive and inclusive people’s participation and sustainable development in the pursuit of economic, social, gender and ecological justice and development so as to bring peace and prosperity to the ASEAN region.

We express serious concerns over the fact that since 2005, the ASEAN Civil Society Conferencehas been submitting extensive recommendations to ASEAN leaders and that not much progress has been made. Therefore, we reiterate our recommendations from the 2011 Forum and call on the ASEAN leaders to take positive actions promptly to implement them.

We reiterate that the people’s participation and a truly people-centered ASEAN is an essential part of the ASEAN community building. The growing awareness of ASEAN and its meetings and institutions by the region's people is encouraging. However, we note with deep disappointment that during the ACSC/APF unacceptable restrictions were imposed on participants’ human rights to freedom of expression and assembly. Certain participants were actively discouraged from attending the ACSC/APF, and workshops on land rights and on Burma/Myanmar were not allowed to take place.

We urge ASEAN leaders to ensure people’s participation and a people-centered ASEAN during 2012, as well as in Brunei in 2013 and Burma/Myanmar in 2014. We deeply appreciate and commend the efforts of the organizers of the ACSC/APF in Cambodia who ensured a robust and independent ACSC/APF and present this statement of key issues and recommendations to the 20th ASEAN Summit in Cambodia.

Problem and Challenge of ASEAN People's Forum in Cambodia (Kingdom of Wonder??????)


Cambodia is a chair person for ASEAN summit from April 2-4. The meeting of ASEAN leaders and with other famous leaders around the world for solving regional problem and the world in which attracts ASEAN people to address their issues for the leader to take into consideration.  In order to bring people concern, NGOs pro and con- government try their best to collect their respectively concern to put ASEAN summit. However in Cambodia, it has two types of ASEAN People's Forum--- one is organized by it's called neutral NGOs in which are needed to rent hotel for hosting the event and another group of NGOs are supported by government and they can use the public property to process their event freely. The latter group, it's called Government NGOs (GONGO).

It doesn't understand why the government needs to divide NGOs into two groups? is there any benefit from this event? Can government of Cambodia hide all main issue in Cambodia for the world?

Confrontation of Neutral group of NGOs
Law Journal of Cambodia (LJC) received information from the Lucky Star Hotel that people who registered to pay fee to attend ASEAN People’s Forum (APF) were more than 1,000 people. People who attended today are around 1,000 but it had problem of obstruction from hotel owner who said that if the people more than 600 as agreed before, the hotel would turn off the light and lock the door because the owner didn’t want to conflict with the higher ranking who ordered him not allow CSOs to organize this event. It said that Ministry of Interior (MoI) issued a warning letter to all hotels to get permission from MoI before agree to rent the place for any event. However, the Lucky Star Hotel owner made contract with CSOs before MoI’s warning letter so he could cancel the contract. Before the door of venue open, the owner of hotel provided condition to participants that all participants must not allowed to wear any stickers on t-shirt to critic government or put sensitive banner hang on the wall, if they don’t agree, the Hotel Owner will not open the door for participants . The CSOs commissions that organize this event facilitate and then agreed hotel condition. And then, the APF started process its agenda. LJC was very regret to hear this information that hotel owner got pressure from government; it’s Rule of Man not Rule of Law. However, through observers of the event, it saw that the people were commitment and talkative in the event which different from the event at Chaktumok Theater.

On the same day on March 29, at 10:00 PM CHRAC and other NGOs commission for organizing the APF were informed by Lucky Star Hotel that it was not allowed to conduct the seminar on Land, Forest and Mine (LFM) issue in hotel. Then the commission decided to move group of seminar on LFM moved to Paranda hotel in front of Inter-continental hotel. 

On March 30, morning at Paranda hotel, people around 150 were conducting seminar on LFM. However during the seminar, the Paranda Hotel informed the organizer that in afternoon, they would not continue to rent room for participants to conduct seminar anymore. 
In afternoon of the same day, all participants went to original hotel (Lucky Star)--- the group of land, forest and mine still were not allowed to conduct discussion excepted group of health, agriculture.

During the seminar at Lucky Star hotel were also interrupted by hotel staff who withdrew the microphone from speaker--- IT'S AMAZING ISSUE.

LJC will provide further information for tomorrow event.

GONGO ISSUE STATEMENT
Our member attended GONGO seminar on March 29, at the session of Challenge of indigenous people in Cambodia. Through observation, we found that the presenters didn't raise about the issue involving indigenous people but they raised only government policy to protect indigenous people. The participant from DPA asked questioned related to IP challenge and issue. He also provided his idea on the matter but he was interrupted by Vietnamese Moderator by giving reason that time was limited for him talk much.

GONGO had conducted their event from March 28-30. Today, March 30, the GONGO proceeded its agenda smoothly because they were supported by the government. This group also issued 8 pages statement for ASEAN leader to consider their concern. Its statement didn't fight the points that people are facing especially related CORRUPTION, LAND CONFLICT, FORCE EVICTION AND DEFORESTATIONS. ITS STATEMENT talked little of problem such gender and development; women and children's; migrant workers and decent work; disability and development; indigenous and ethnic group; democracy and human rights (just want ASEAN leader to implement ASEAN charter and other document related human rights); Natural resource, environment and climate change (Must adopt love natural and environment????????); livelihood improvement .....for more information please link here to read the original draft of GONGO statement.
