Key Media Messages agreed in principle by Core CSO Group on the LANGO

Recently, the core group on draft of NGO law will issue its memo to media to talk one voice relating to NGOs Law (LANGO). The content of such memo is reacted with government official had intention to omit the provision of mandatory registration for NGO or Association in the draft law according to Cambodia Daily Newspaper issued on Oct 27, 2011.

The draft of key messages to media released focuses on three points-(1) Registration, (2)-Operation of informal group, (3)-Public consultation of fourth LANGO.

The core group of LANGO are excited to welcome the intention of government to collaboration with civil society to improve the provision of LANGO. It's also appealed the government to issue the fourth draft of LANGO for publicity to process the consultation. The key message also called the government that Community Bases Organization (CBO) will be freely operate their working without interruption from the local authority if they don't register as legal entity.

The core group reiterated that when the NGOs or association register to become the juridical person, the such NGOs or Associations shall be exempted taxation payment to the state.

About taxation matter, LJC would like to express our intention that through taxation law in 1997 and amended law in 2003, the state will exempt income taxation from legal entity that have purpose or objective to serve as only religious, science, charity, literature and or education (please read article 9 (b) (new amendment in 2003)).

Why does Civil Society Organization (CSO) need or request the existent law?  Why don't they demand more that law state?

What the law mentioned,CSOs have rights to get it ready, the government officials don't have rights to object the rights provided by law so CSOs do not need to appeal against this matter again. This action might hand over to the government rethink to amend the taxation law to do pressure against CSOs. The CSOs should demand more benefits from the government such retire fund or salary when the CSOs staff retired from their positions because those staffs pay tax of salary to government therefore the government shall return something back to CSO staff.

We hope that CSOs in Cambodia understand their roles and positions clearly.
